These Terms & Conditions (“Terms”) govern your use of clearpathguide.us and services offered by ClearPath Home Advisory (“ClearPath,” “we,” “our,” or “us”), a service operated by Julie Anne Normand. By using the website, scheduling a visit, or requesting services, you agree to these Terms.
1. ClearPath’s Role
ClearPath provides home-planning information, general education, project sequencing, recommendations, and introductions to home-service professionals or product providers.
Unless expressly stated in writing, ClearPath is not acting as your attorney, engineer, architect, financial adviser, insurance adviser, home inspector, or licensed contractor. Information we provide is general and should not replace advice from an appropriately licensed professional when one is required.
2. Complimentary In-Home Planning Visits
The initial ClearPath In-Home Planning Visit is complimentary and typically takes 30–45 minutes. There is no obligation to purchase a product or service.
If you need to cancel or reschedule, we ask that you provide at least 24 hours’ notice whenever possible. ClearPath may reschedule or decline an appointment because of safety concerns, incorrect information, travel limitations, emergencies, or circumstances outside our reasonable control.
3. Recommendations and Your Decisions
Recommendations depend on the information available at the time, the conditions we can reasonably observe, your stated priorities, and the providers or products known to us. ClearPath does not evaluate every provider or product in the market and does not guarantee the lowest available price.
You remain responsible for:
- Reviewing estimates, contracts, warranties, financing terms, and cancellation rights.
- Confirming licenses, insurance, permits, HOA requirements, property restrictions, and technical specifications.
- Deciding whether a product, provider, project, or financing arrangement is appropriate for your household.
4. Provider Network and Compensation
ClearPath may receive compensation when a homeowner purchases certain products or services through a provider in our network. Depending on the project, compensation may take the form of a referral fee, commission, marketing fee, or margin included in the transaction.
This means ClearPath may have a financial interest in a recommendation. You are not required to use a provider we recommend, and you may ask how ClearPath is compensated for a specific recommendation.
5. Third-Party Providers
Home-service professionals, installers, contractors, manufacturers, lenders, and other providers are separate businesses responsible for their own products, services, employees, licenses, insurance, estimates, agreements, warranties, representations, and legal compliance.
Any purchase or project agreement is between you and the applicable provider unless a written agreement expressly identifies ClearPath as a contracting party. A provider’s contract controls the scope, price, timing, warranty, and performance of that provider’s work.
ClearPath does not guarantee that any provider will accept a project, meet a particular schedule, obtain required approvals, or deliver a particular outcome.
6. Estimates and Home Information
Any preliminary price, savings figure, timeline, performance projection, or project description is an estimate unless stated otherwise in a signed agreement. Actual results may vary because of home conditions, utility rules, product availability, permitting, financing, usage, weather, and other factors.
You agree to provide accurate information and to disclose conditions that may reasonably affect a visit or recommendation, including access restrictions, known hazards, pets, construction activity, or property limitations.
7. Communications
When you request an appointment or information, you authorize us to contact you regarding that request using the contact information you provide. Communications may include appointment confirmations, reminders, scheduling messages, and service-related follow-up.
Marketing text messages will be sent only as permitted by law and applicable consent. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Carriers are not responsible for delayed or undelivered messages.
8. Website Use and Intellectual Property
The website and its text, graphics, branding, guides, and other content are owned by ClearPath or used with permission. You may use the website for personal, noncommercial purposes. You may not copy, republish, sell, interfere with, or misuse the website or its content without written permission.
You may not use the website to submit unlawful, fraudulent, harmful, or misleading information or to interfere with its operation or security.
9. Privacy
Our collection and use of personal information are described in the ClearPath Privacy Policy.
10. Disclaimers
The website and complimentary advisory services are provided on an “as available” basis. To the extent permitted by law, ClearPath disclaims implied warranties concerning the website and general advisory information.
Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.
11. Limitation of Liability
To the extent permitted by law, ClearPath will not be liable for indirect, incidental, special, or consequential damages arising from use of the website, reliance on general advisory information, or the acts or omissions of an independent third-party provider.
ClearPath remains responsible for liability that cannot lawfully be limited or excluded.
12. Changes
We may update these Terms periodically. Revised Terms will be posted on this page with a new effective date. Changes apply prospectively from the posted effective date.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute will be handled in a court with proper jurisdiction unless the parties agree to another lawful resolution process.
